These Terms of Use (“Terms”) govern your access to and use of the website located at elkridgeinteriors.com (the “Site”), operated by Elk Ridge Interiors (“Company,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1) Website Purpose — Informational Only
The Site provides general information about our remodeling, restoration, and epoxy services, including example processes, project descriptions, images, estimated timelines, and general guidance. This content is provided for informational purposes only and is not professional advice (engineering, legal, financial, or otherwise). Any project requires a project-specific evaluation and a signed written agreement to define scope, price, and schedule.
2) No Offer; Estimates and Timelines Are Not Binding
Nothing on this Site is an offer to perform services at a guaranteed scope, price, or timeline. Any pricing, ranges, examples, and schedules shown are illustrative and can change due to site conditions, code requirements, material lead times, subcontractor availability, permitting/inspection requirements, weather, hidden conditions, and other factors.
A project becomes binding only when both parties execute a written agreement (proposal/contract/change order) signed by both parties.
3) Consultation & Estimating Fee
We charge a $150 consultation and estimating fee for detailed quoting and thorough consultation. After you schedule a consultation, we will invoice this fee. If you proceed under a signed agreement, the $150 may be credited toward your final invoice, as disclosed in writing at the time of invoicing and/or in the project agreement.
We may decline estimate requests or consultations at our discretion.
4) Acceptable Use; Prohibited Conduct
You agree not to:
use the Site for unlawful purposes;
attempt to gain unauthorized access to the Site or related systems;
scrape, harvest, copy, or commercially exploit Site content, pricing structures, templates, or processes;
interfere with Site operation or introduce malware;
impersonate another person or misrepresent affiliation.
We may restrict or block access to the Site for violations of these Terms.
5) Intellectual Property
All content on the Site—including text, photos, videos, graphics, designs, logos, project descriptions, process flows, templates, and other materials—is owned by Company or licensed to Company and protected by intellectual property laws.
You are granted a limited, revocable, non-transferable license to view the Site for personal, non-commercial use only. No other rights are granted.
6) Anti–Bid-Shopping / Misuse of Consultation Deliverables
Our consultations and estimates may include detailed scope breakdowns, sequencing, sketches, concept visuals, and documentation created through significant time investment. This work product is provided to help you evaluate your project with us.
You may not use, share, or repurpose consultation deliverables (including scope notes, sketches, proposal drafts, pricing breakdowns, takeoffs, sequences, or other outputs) to:
solicit competing bids,
replicate our workflow, documentation, or methodology,
provide our deliverables to another contractor or vendor for pricing or execution,
or otherwise use our deliverables to obtain “apples-to-apples” pricing from others.
Important: This Site’s Terms are not a substitute for a signed project agreement. For stronger enforceability, you will be asked to accept the consultation policy and the restrictions on deliverables during the estimate request and/or scheduling process, where applicable.
We reserve the right to decline service and pursue available remedies if deliverables are misused.
7) User Submissions (Contact Form, Photos, Files)
When you submit information via the Site—including name, email, phone number, preferred contact method, availability, service selection (restoration/remodel/epoxy), budget, desired start date, project details, and uploaded photos/files—you represent that you have the right to provide it and that it is accurate to the best of your knowledge.
You grant Company permission to use your submissions to evaluate your request, communicate with you, prepare estimates, schedule consultations, and (if hired) perform services. We may retain submissions for recordkeeping and operational purposes.
8) Communications Consent (Email, Phone, SMS/Text)
By providing your phone number and/or email, you consent to receive communications from us related to your inquiry, consultation scheduling, estimate delivery, project coordination, and service updates via phone calls, email, and text messages. Message and data rates may apply.
You may opt out of non-essential marketing messages at any time. Operational messages related to an active inquiry or project may still be sent as necessary.
9) Scheduling Tools and Payments
We may use third-party tools for scheduling consultations (e.g., Calendly). We may invoice and accept payments through third-party processors (e.g., QuickBooks). Your use of those third-party services is subject to their terms and policies. We are not responsible for third-party systems, outages, or errors.
10) Analytics, Cookies, and Tracking Technologies
We use analytics and tracking technologies to understand site performance and improve marketing and user experience. This may include:
Google Analytics (to measure traffic, page performance, and conversions), and
Meta Pixel (to measure ad performance and enable remarketing).
These tools may use cookies and similar technologies. Your choices and rights related to cookies/tracking (where applicable) are described in our Privacy Policy. By using the Site, you acknowledge that such tools may be used as described.
11) Third-Party Links and Services
The Site may contain links to third-party websites (vendors, manufacturers, review platforms, payment processors, scheduling tools, etc.). We do not control third-party sites and are not responsible for their content, security, or policies.
12) Testimonials, Media, and Project Photos
We may display testimonials and project photos/videos on the Site. We do not disclose homeowner addresses or identifying occupant information. Project visuals may be representative and may include edited images.
If you believe content identifies you, contact us, and we will review it promptly.
13) Disclaimers
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses.
14) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE.
IN NO EVENT WILL COMPANY’S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE EXCEED $500.
15) Indemnification
You agree to defend, indemnify, and hold harmless Company and its owners, employees, contractors, and agents from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your submissions, or your violation of these Terms.
16) Project Contracts Govern Services
If you hire the company for services, the relationship is governed by a separate written agreement (proposal/contract/change orders). That agreement controls scope, payment, schedule, warranties, and disputes for the project.
17) Changes to These Terms
We may update these Terms at any time. The “Last Updated” date reflects the most recent version. Your continued use of the Site after changes means you accept the updated Terms.
18) Governing Law; Venue
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Any dispute arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Routt County, Colorado, and you consent to personal jurisdiction there.
